Terms of Service

1. Agreement to these terms
These terms govern your use of archived, the artwork inventory service available at archivedonline.com (the “Service”). By creating an account or using the Service you agree to these terms. If you do not agree, please do not use the Service.
2. The Service
archived lets you catalogue artworks, track their locations and exhibition history, manage related contacts, and export your records as PDF and CSV files.
The Service is currently in early access and is provided free of charge. We may introduce paid plans in the future. If we do, we will give you reasonable notice, and you will never be charged without explicitly signing up for a paid plan.
3. Your account
You need an account to use the Service. You must provide accurate information, keep your sign-in credentials secure, and be at least 16 years old. You are responsible for activity that happens under your account.
4. Your content
You retain all rights to the content you add to the Service, including artwork records, images, and contact details. We claim no ownership of it.
So that we can operate the Service, you grant us a limited licence to host, store, process, and display your content back to you. We use this licence only to provide and maintain the Service, never to publish, sell, or promote your content.
You are responsible for your content, including making sure you have the right to upload it and that storing any third-party contact details complies with applicable law.
5. Acceptable use
When using the Service you agree not to:
- break the law or infringe anyone else’s rights;
- upload malicious files or content;
- attempt to access other users’ data or probe, scan, or test the security of the Service;
- scrape the Service or place unreasonable load on it through automated means.
6. Availability and changes
The Service is in active development. Features may change, be added, or be removed, and occasional downtime may occur. We work to keep your data safe, but you should keep your own copies of important records, and the built-in CSV and PDF exports make this easy.
7. Ending your use of the Service
You can stop using the Service and request deletion of your account and data at any time (see our Privacy Policy). We may suspend or terminate accounts that breach these terms, and where reasonable we will notify you and give you a chance to export your data first.
8. Disclaimers
The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we make no warranties, express or implied, about the Service, including its reliability or fitness for a particular purpose.
Nothing in these terms excludes, restricts, or modifies any consumer guarantee or right you have under the Australian Consumer Law or other applicable law that cannot be excluded.
9. Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, or consequential loss arising from your use of the Service, and our total liability for any claim is limited to the amount you paid us for the Service in the 12 months before the claim arose.
10. Governing law
These terms are governed by the laws of New South Wales, Australia, and disputes are subject to the non-exclusive jurisdiction of the courts of New South Wales.
11. Changes to these terms
We may update these terms from time to time. If we make material changes we will give you notice through the Service or by email before they take effect. Continuing to use the Service after changes take effect means you accept the updated terms.
